Terms of Service

By accessing or using PropAI (“the Service”), operated by Deific Digital (“we”, “us”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

PropAI is a CRM and WhatsApp automation platform that lets real estate businesses (“Customers”) respond to buyer enquiries, qualify leads, schedule site visits and manage their pipeline through the WhatsApp Business Platform. Features may change over time.

You must be at least 18 years old and legally able to enter into a contract. You are responsible for your account credentials and all activity under your account, and you must provide accurate information.

You agree to:

• comply with the WhatsApp Business Terms, WhatsApp Business Policy, WhatsApp Commerce Policy and Meta Platform Terms;
• message only people who have given valid opt-in consent;
• not send spam, unsolicited bulk messages or misleading content (including misleading property listings or prices);
• have a lawful basis and your own privacy notice for processing your End Users’ data;
• respond to data requests from your End Users.

You must not use the Service for illegal activity, fraud, harassment, hate speech, adult content, gambling, weapons, drugs, scams, malware, or anything prohibited by Meta or WhatsApp policies. You must not attempt to hack, reverse-engineer, overload or resell the Service without our permission.

The Service depends on third parties such as Meta/WhatsApp, Google and Hostinger. Their availability, pricing and policies are outside our control. Meta may charge messaging fees directly to you or through us. We are not responsible if Meta restricts, suspends or bans your WhatsApp number or account.

Chatbot replies may be generated by AI (Google Gemini) and can be inaccurate or incomplete. You are responsible for reviewing your chatbot configuration, listing information and the replies sent to your End Users. AI replies should not be relied on as legal, financial or investment advice, and property details must be verified by you before they are shared.

Paid plans are billed as shown on our website or agreed in your order, which may include a one-time setup fee and a monthly charge. Fees are non-refundable unless stated otherwise or required by law. Applicable taxes, including GST, are extra. We may change pricing with prior notice.

Our handling of personal data is described in our Privacy Policy. You retain ownership of your data and grant us the right to process it to provide the Service.

The Service, its software, branding and content belong to Deific Digital. We grant you a limited, non-exclusive, non-transferable right to use the Service. You may not copy or resell it without written permission.

We may suspend or terminate your access if you breach these Terms, violate Meta or WhatsApp policies, or misuse the Service. You may stop using the Service and close your account at any time. On termination, your data is deleted as described in the Privacy Policy.

The Service is provided “as is” and “as available”. We do not guarantee uninterrupted, error-free or secure operation, or that every message will be delivered.

To the maximum extent permitted by law, Deific Digital is not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or business. Our total liability is limited to the amount you paid us in the 3 months before the claim.

You agree to indemnify Deific Digital against claims arising from your misuse of the Service, your content, or your violation of law or third-party policies.

We may update these Terms. Continued use of the Service after changes means you accept them.

These Terms are governed by the laws of India. Courts at Kanpur, Uttar Pradesh have exclusive jurisdiction.
